TR∆DING TERMS & CONDITIONS
To be eligible to purchase products on our web-site you must be over 18 years of age; register by providing your full name, address, e-mail address, details of your debit or credit card and other requested information. We are unable to process your order without this information. We will also ask for a contact telephone number so that we can contact you if there is a problem with your order and we may on occasion pass this number on to a delivery company in the event that they need to contact you regarding your delivery.
You will receive an order acknowledgement detailing the products you have ordered once your order has been processed. The reference number on the order acknowledgement should be quoted in any correspondence to us relating to the order. Please note that the order acknowledgement is not an acceptance or confirmation of your order. Once we have accepted your order it becomes binding, subject to your rights of cancellation.
Non-acceptance of your order will occur if the product is out of stock, we identify a pricing or product description error or we are unable to obtain authorisation for your payment.
For rug orders, including bespoke orders, the acceptance of your order will be when we send you a confirmation of order e-mail or when the order is despatched, whichever is the earlier, unless of course we have notified you that we do not accept your order or you have cancelled it in accordance with these Terms and Conditions.
We reserve the right to reject an order at any time. You must provide a valid delivery address within the areas we deliver to (see delivery and returns policy). We will only deliver to a residential or business address. Please note that PO Box numbers, hotels and temporary accommodation addresses are not acceptable.
It is your responsibility to check that all details of your order, such as dimensions, specifications, measurements, access and delivery, are correct and suitable to your requirements prior to placing your order to avoid additional charges.
We reserve the right to withdraw any products from our website at any time and to remove or edit any materials or content contained herein. We may refuse to process a transaction for any reason or refuse service to anyone at any time at our sole discretion.
We are unable to change orders for bespoke items like our rugs, so any amendments must be advised within 48 hours of placing the order. The original order will then be cancelled and a new order will need to be placed.
PRICES ∆ND P∆YMENTS
All prices on the web-site are in Pounds Sterling and include VAT. Delivery costs will be added to the total amount due at Checkout. Payment must be made in advance for all goods and services by credit or debit card at the time of ordering.
All credit or debit card holders will be subject to validation checks and authorisation by the card issuer. If the issuer of your payment card does not authorise payment to us we will not be liable for any delay or non-delivery of your order. By agreeing to buy a product you authorise us to transmit your information to and to obtain information about you from third parties in order to authenticate your identity and payment. In the event of a delay in payment we may cancel or suspend any other outstanding order until you have paid the due amounts.
We reserve the right to modify incorrectly priced items after sale and we may refuse to process any order or service at any time.
Promotional codes may be used on our web-site checkout only in the time specified.
DESCRIPTION
All reasonable care is taken to ensure that product details and descriptions entered on to our web-site are accurate. The images shown are for illustration purposes and do not include any props used in photography. Please refer to the production description for detailed information.
BESPOKE ITEMS
Bespoke items including rugs will be commissioned specifically for you. We will send you full details of the proposed work in an order confirmation along with colour tufts or other relevant materials. The order confirmation must be signed, dated and returned to us by post, confirming your selection or via email directly to the sale person. For all bespoke items we require a deposit of 50% of the value of the order prior to the work commencing. We will inform you when the goods are ready for despatch and request payment of the balance due on the order prior to the goods being despatched. You may without charge cancel your order at any time up to returning the signed order confirmation. If you cancel the order after returning the signed order confirmation but before despatch of the goods you will be charged a cancellation fee of 50% of the total commissioned order. We cannot issue refunds on bespoke items once they have been despatched to you.
LIMIT∆TION OF LI∆BILITY
Our liability to you under these Terms and Conditions will not exceed the total value of the order. Neither of us shall be responsible for loss of income, loss of business, loss of anticipated savings, loss of data, or waste of time. We will not be liable for any defect in the goods arising from: fair wear and tear; wilful damage; accident; negligence by you or any third party; your using the goods in a way that we or the manufacturers do not recommend; your failing to follow the manufacturer’s and/or our instructions; or from any alteration or repair you carry out without our prior written approval. We accept no liability for any offence you may suffer as a result of the goods as you are deemed to have satisfied yourself of the nature and type of goods to be purchased before placing an order with us.
PRODUCT USE
Our products are designed for domestic use only. If products are intended for non-domestic or commercial use, it is your responsibility to check the product suitability with the relevant authorities prior to placing the order. In any event, we will not be held responsible for goods used in a commercial environment.
EVENTS BEYOND OUR CONTROL/ FORCE M∆JEURE
We cannot be held liable if events that are beyond our control affect our ability to meet these Terms. We will make all reasonable efforts to deliver a good standard of service, but we may extend our delivery times in these circumstances. Such events include (but not limited to) industrial, civil, military or terror action, fire, natural disaster, interruption of transport or communication networks, and failure by our suppliers to supply the goods to us. If we have been unable to overcome such an event within 4 weeks we will cancel your order if you would like and provide a full refund and without any further penalty.
∆SSIGNMENT
You may not transfer any of your rights or obligations under these Terms to another person without our prior written consent, which we will not withhold unreasonably. We can transfer all or any of our rights and obligations under these Terms to another organisation, but this will not affect your rights under these Terms.
COPYRIGHT
All copy, illustrations, images, graphics, and logos are subject to copyright. Any unauthorised copying will constitute an infringement of copyright. We reserve the right to vary or withdraw these Terms from time to time as we see fit.
PRIV∆CY POLICY
Claire ∆lderdice Textiles are committed to ensuring that your privacy is protected. Should we ask you to provide certain information by which you can be identified when using our website, then you can be assured that it will only be used in accordance with this privacy policy. This policy may change from time to time so we advise that you refer to this page when ordering to ensure that you are happy with any changes.
We do not store credit card details nor do we share customer details with any third parties, other than your contact telephone number in the event that the delivery company is unable to deliver for whatever reason. Any information collected such as name, email address, area, preferences etc may be used in customer surveys or to promote new products or special offers.
SECURITY
We are committed to ensuring that your information is secure. In order to prevent unauthorised access or disclosure, we have put in place suitable physical, electronic and managerial procedures to safeguard and secure the information we collect online.
JURISDICTION
The contract between us and these Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales, and any dispute arising under them shall be subject to the exclusive jurisdiction of the courts of England and Wales.
